TERMS & CONDITIONS

Booking Your Holiday

  1. Booking Your Holiday

    a) Your contract in respect of your holiday is made with Myekashmir Travels (hereinafter referred to as “the Company”), registered in India, and all bookings are subject to these terms and conditions.

    b) All communications by Myekashmir Travels in relation to your holiday will be sent to the address stated on the booking form.

    c) All bookings must be made through an authorised representative of Myekashmir Travels. At the time of booking, the Myekashmir Travels booking form must be completed and submitted together with a deposit of 50% of the total cost of the booking.

    d) Receipt of the deposit and booking form by Myekashmir Travels does neither guarantee nor imply confirmation of the booking. No booking shall be confirmed until Myekashmir Travels issues a written notice. Myekashmir Travels reserves the right to refuse a booking without giving any reason and shall in that event return any deposit received.

    e) Your holiday must be paid in full at least 30 days before the departure date. If payment is not received by the due date, Myekashmir Travels reserves the right to cancel the booking and retain the deposit. The person who signs the booking form guarantees payment of the total amount shown on the booking form in accordance with these conditions. It is the responsibility of the signatory to ensure Myekashmir Travels receives payment in full by the due date. No reminders will be sent.

    f) If you book within 30 days of your departure date, payment must be made in full at the time of booking.

    g) All special requests, such as dietary requirements, should be noted on the Myekashmir Travels booking form.

    h) Myekashmir Travels will provide the service as set out and confirmed in writing.

  2. Tour Cost Includes

    • Welcome & Greet
    • All Sightseeing as per itinerary.
    • 01 hour Shikara Ride Complementary.
    • Pickup & Drop Srinagar airport
    • Accommodation in above mentioned hotels
    • Transportation by tempo traveller (23 seats with AC)
    • All Applicable Luxury Taxes of Hotel.
    • Day Excursion of Sonmarg /Gulmarg
    • Local sightseeing of Mughal Gardens.
    • Toll tax, diesel, parking and driver allowances.
    • Meals (Breakfast & Lunch or Dinner)
  3. Tour Cost Excludes

    • Coolie / porter charges.
    • Camera charges, Donations at Temples.
    • Extended stay or travelling due to any reason.
    • Any meals other than those specified in Tour Cost Includes.
    • Expenses of personal nature such as tips, telephone calls, laundry, liquor etc.
    • Oxygen cylinder/can
    • Any other item not specified in ‘Tour cost includes’
    • Local Transport of Destinations Like (Sonmarg, Pahalgam, Gulmarg)
    • Horse Riding
  4. Cancellation and Refund Policy

    • 100% refund if informed within 06 days.
    • No refund will be initiated if exceeds 03 days.
  5. Supplement Cost

    • Pahalgam Inner line sightseeing charges @ 3000/- by Cab.
    • Gondola tickets charges @ 1900/- per head up to 2nd Phase
    • Horse Ride at Gulmarg, Sonmarg & Pahalgam
    • ATV Bike Ride @ 800 – 1200 per bike for 01 Round at Gulmarg
    • Snow Skiing at Gulmarg rates as per request
    • Shikara ride at Srinagar on Dal lake @ 600/- for 1 hour
    • Snow Jeep Cab charge @ 2400/- both way to Tangmarg to Gulmarg and back to Tangmarg Road Block
  6. Additional Terms & Conditions

    • As per the Government directive, foreigners are requested to produce their passport as photo identity proof and Indians can produce any govt approved photo identity such as Driving License/Pan Card/Voter ID card/Passport at the point of check-in at the hotel.
    • Tourists are responsible for carrying, shifting, and taking care of their own luggage.
    • All Prices are in Indian Rupees and valid for Indian Nationals only.
    • Rooms are subject to availability at the time of receiving firm booking.
    • In case of non-availability of the mentioned hotels, similar kind/quality of hotels will be provided, which can change the above package cost.
    • 100% Advance shall have to be paid before departure out of which 50% has to be paid at the time of booking the tour.

Responsibilities

  1. Company’s Responsibilities

    a) Myekashmir Travels does not own or manage the aircraft, accommodation, restaurants, and other facilities used in conjunction with the tours arranged. While Myekashmir Travels has exercised care in selecting providers of travel, accommodation, restaurants, and other facilities, Myekashmir Travels has not had the opportunity to inspect and does not represent that such aircraft, accommodation, restaurants, and other facilities and services have been inspected.

    b) Myekashmir Travels is not responsible if you or any member of your party suffer death, illness, or injury as a result of any failure to perform or improper performance of any part of our contract with you where such failure is attributable to (i) the acts and/or omissions of any member of the party, or (ii) those of a third party not connected with the provision of your holiday, or (iii) an event which neither Myekashmir Travels nor the service provider could have foreseen or prevented even with due care.

    c) Should any member of your party suffer illness, injury, or death through misadventure arising out of an activity, which does not form part of the holiday Myekashmir Travels has arranged for you, Myekashmir Travels cannot accept liability. Myekashmir Travels will offer general assistance where appropriate.

  2. Your Responsibilities

    a) You are responsible for arranging your own travel insurance, though an appropriate policy can be incorporated into your tour package. Details of all insurance policies held by each member of your party must be provided on the booking form. No booking forms can be accepted without sufficient proof that personal policies have been arranged. Please ensure that your insurance cover applies to the specific activities you are booking and which are confirmed on the Confirmation Invoice.

    b) Each member of the party must have a valid passport, visas, and all necessary documentation for the countries they are touring. Myekashmir Travels accepts no responsibility for any delay or expense should your documents not be in order.

    c) You are responsible for checking in for flights at the correct time and for presenting yourself to take up all pre-booked components of your holiday. Myekashmir Travels cannot accept responsibility for clients missing flights as a result of late check-ins, and no credit or refunds will be given if you fail to take up any component of your holiday. No credit or refunds will be given for lost, mislaid, or destroyed travel documents.

    d) By booking a holiday with Myekashmir Travels, you undertake to behave in an orderly manner and not to disrupt the enjoyment of others on holiday or prejudice Myekashmir Travels’ reputation with our customers, suppliers, or hotel owners. If you breach this clause your holiday may be terminated immediately and Myekashmir Travels will have no further contractual obligations towards you. Myekashmir Travels will be entitled to recover the cost of any damage caused by you.

  3. Excursions and Activities

    a) Myekashmir Travels, our representatives, or employees may provide you with information (before departure and/or when you are on holiday) about activities and excursions that are available in the area you are visiting. Myekashmir Travels has no involvement in such activities or excursions which are neither run, supervised, or controlled in any way by Myekashmir Travels. They are provided by local operators or other third parties who are entirely independent of Myekashmir Travels and do not form any part of your contract with Myekashmir Travels even where Myekashmir Travels suggests particular operators/other third parties and/or assists you in booking such activities or excursions in any way.

    b) Where you choose to book and/or pay for any such activities or excursions, your contract will be with the local operator or third party concerned and not with Myekashmir Travels. Myekashmir Travels has no liability for any such activities or excursions and any claim which you might have arising out of your participation in any of these activities or excursions will be against the local operator or third party and subject to its terms and conditions.

  4. Complaints

    a) If you have a complaint about your arrangements while away, you must immediately notify the supplier of the service in question locally. If they cannot resolve the problem immediately, you should contact Myekashmir Travels at the earliest opportunity to allow us to assist.

    b) If you are not satisfied with how your complaint was handled, please follow this up within 28 days of your return home by writing to our customer services department at Myekashmir Travels, mentioning your booking reference and all relevant information. Please keep your letter concise and to the point. This will assist us to quickly identify your concerns and speed up our response to you.

Law & Jurisdiction

These Booking Conditions are governed by the law of India and the jurisdiction of the Indian Courts.
